These Terms of Service (“Terms”) govern your access to and use of ResumeStitch (the “Service”), operated as a sole proprietorship based in San Antonio, Texas, United States (“ResumeStitch”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
2. Your account
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- We strongly recommend enabling multi-factor authentication. Notify us promptly at support@resumestitch.com of any unauthorized use.
- You may not share your account or transfer it to another person.
3. Description of the Service
ResumeStitch helps you tailor resumes and related materials to specific job descriptions using artificial intelligence. The Service is a tool to assist you; it does not guarantee any particular outcome, including interviews, job offers, or employment.
4. Your content and license
You retain all ownership of the resumes, job descriptions, and other materials you submit (“Your Content”). You grant ResumeStitch a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content — including transmitting it to our AI and infrastructure providers — solely to operate and provide the Service to you. This license ends when you delete Your Content or your account, subject to the retention practices described in our Privacy Policy.
You represent and warrant that you own or have the necessary rights to Your Content, that it is accurate, and that its processing through the Service does not violate any law or third-party rights.
5. AI-generated content
- Output is generated by automated systems and may be inaccurate, incomplete, or misleading. You are solely responsible for reviewing, editing, and verifying it before use.
- You must ensure that any resume or application you submit to an employer is truthful and not misleading. Do not use the Service to fabricate qualifications or misrepresent your experience.
- The Service does not provide legal, career, financial, or other professional advice.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Upload content you do not have the right to use, or that infringes others' rights.
- Attempt to reverse engineer, scrape, overload, disrupt, or gain unauthorized access to the Service or its systems.
- Circumvent usage limits, rate limits, or security measures.
- Resell or commercially exploit the Service without our written permission.
7. Plans, billing, and cancellation
- The Service offers a free tier with monthly usage limits and paid subscription plans (e.g., Pro and Career). Current pricing is shown on our website.
- Paid plans are billed in advance through Stripe on a recurring basis and renew automatically until cancelled. You authorize us and Stripe to charge your payment method for each billing period.
- You may cancel at any time from your account; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Except where required by law, fees are non-refundable. We may change pricing on a prospective basis with notice before your next renewal.
8. Intellectual property
The Service, including its software, design, and trademarks, is owned by ResumeStitch and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
9. Third-party services
The Service relies on third-party providers (including Anthropic, AWS, Stripe, SendGrid, Sentry, and Google) and may link to third-party websites. We are not responsible for third-party services, and your use of them may be subject to their own terms.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. Upon termination, your right to use the Service ceases; sections intended to survive (including content licenses for residual copies, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ITS OUTPUT WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMESTITCH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
13. Indemnification
You agree to indemnify and hold harmless ResumeStitch from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, the state and federal courts located in Bexar County, Texas will have exclusive jurisdiction over any dispute not subject to arbitration.
Binding arbitration. Except for claims that may be brought in small-claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Texas. Class-action waiver: you and ResumeStitch agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. You may opt out of this arbitration agreement by emailing support@resumestitch.com within 30 days of first accepting these Terms.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous
- If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
- Our failure to enforce a provision is not a waiver of our right to do so later.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- These Terms, together with the Privacy Policy, are the entire agreement between you and ResumeStitch regarding the Service.
